Can the bank require a customer to purchase the products which are not included in the banking service package?

The bank is prohibited from requiring customers to purchase any products or services from the bank or a related party/affiliate, as a prerequisite for the provision of these services (except for the provision of the banking service package).

Is the bank entitled to amend the agreement?

The bank is not entitled to unilaterally amend the agreements concluded with customers, unless is otherwise stipulated by the agreement or by law.

Can the agreement on the provision of the banking service be terminated early? How to terminate such an agreement?

Pursuant to art. 651 of the Civil Code of Ukraine, the agreement can be unilaterally terminated, by sending the relevant notice to the Borrower. The agreement shall be deemed as terminated on the date stated in the notice. Nevertheless, on the last day of the Agreement validity, the Borrower shall undertake to return the loan amount in full to the lender and completely fulfill other obligations under the agreement. An unilateral withdrawal from the agreement, shall not release the Borrower from the liability for breaching the contractual obligations.

What are the possible consequences for a customer in the case of an improper use of the banking service or the failure to fulfill obligations under the agreement on the provision of this banking service?

In the case of making untimely payments under the housing loan the customer shall:

  • pay the percentage in the amount of the currently valid double interest rate pursuant to the agreement, within the relevant period, on the overdue amount of the principal for the use of the loan, from the day following the date since the obligation becomes overdue; the customer shall pay to the bank the interest of the amount under the loan not-repaid in time, which, pursuant to Part 2 Art. 625 of the Civil Code of Ukraine shall be established by the agreement of the parties as a percentage of the overdue amount of the loan principal in the size of the doubled interest.
  • the penalty in the amount of the NBU double accounting rate, valid within the period for which the penalty shall be paid, on the amount of the late payment, but not less than 1 hryvnia for each day of delay and not more than 15 percent of the late payment amount. The penalty shall be paid in hryvnia.

Can a customer, upon the termination of the agreement, obtain a certificate confirming that parties have fulfilled their contractual obligations?

Yes. A customer, upon the termination of the agreement on provision of the banking service, , including in connection with the expiration, termination or fulfillment of obligations under the agreement, has the right to request the bank to provide the certificate confirming that the parties have fulfilled their contractual obligations, including with the option to obtain the information (a certificate) on the absence of debt and on the customer’s full execution of the obligations under the agreement, which the bank shall provide in the form of a paper or as an electronic document (at the customer’s choice) within five business days from the day when the bank receives such a request.

The customer may order the electronic document (the certificate) on his/her own in Privat24, by going to the menu - “Services – Certificates - Standard certificates” (the needed certificate should be selected from the list) – “Certificate on Card/Account Closure”/ “Certificate on the Loans”/ “Certificate on the existing/absent debt in the bank”.

The customer may visit the bank branch and obtain the certificate in a paper medium, which will be charged at the bank’s current rates.

Customer category

  1. War veterans and their family members; combatants; persons with disabilities due to the war; families of deceased (fallen) war veterans, as defined by Article 10 of the Law of Ukraine “On the Status of War Veterans, Guarantees of their Social Protection”, and families of deceased (fallen) Defenders of Ukraine.
  2. Internally displaced persons.
    2.1. A family member of an internally displaced person in the first degree of kinship if the loan is provided to this family member for the purchase of housing or for property rights to housing in favor of the internally displaced person who shall transfer such housing or the property rights to housing in a mortgage to a lender in the manner prescribed by law.
  3. Other citizens of Ukraine who do not own residential real estate or whose ownership does not exceed 52.5 sq.m. for a family of one person (a single person) and, additionally, 21 sq.m. for each subsequent family member (excluding the residential real estate objects located in the territories of active hostilities, in the territories of active hostilities where operate state electronic informational resources or in the territories of Ukraine which are temporarily occupied by the russian federation and included in the list of territories where the hostilities have been (were) taking place or the territories temporarily occupied by the russian federation, approved by the Ministry of Reintegration, for which the end-date of the hostilities or of the temporary occupation is undetermined; and the real estate objects owned (co-owned) by the borrower and/or his/her family members are destroyed or damaged).

Real estate of the borrower

A candidate and his///her family members do not own residential real estate (and future residential real estate objects, the special property right to which is registered in the State Register of Real Estate Rights) the total area of which equals to or exceeds 52.5 sq.m. for a family of one person (a single person) and, additionally, 21 sq.m. for each subsequent family member (excluding the residential real estate objects located in the territories of active hostilities, in the territories of active hostilities where operate state electronic informational resources or in the territories of Ukraine which are temporarily occupied by the russian federation and included in the list of territories where the hostilities have been (were) taking place or the territories temporarily occupied by the russian federation, approved by the Ministry of Reintegration, for which the end-date of the hostilities or of the temporary occupation is undetermined; and the real estate objects owned (co-owned) by the candidate and/or his/her family members are destroyed or damaged).

Within 12 months prior to the loan application date, the candidate and his/her family members have not alienated residential real estate objects, the total area of which, including the area of housing owned by the family on the application date, equals to or exceeds 52.5 sq.m. for a family of one person (a single person) and, additionally, 21 sq.m. for each subsequent family member (excluding the residential real estate objects located in the territories of active hostilities, in the territories of active hostilities where operate state electronic informational resources or in the territories of Ukraine which are temporarily occupied by the russian federation and included in the list of territories where the hostilities have been (were) taking place or the territories temporarily occupied by the russian federation, approved by the Ministry of Reintegration, for which the end-date of the hostilities or of the temporary occupation is undetermined; the real estate objects owned (co-owned) by the candidate and/or his/her family members are destroyed or damaged).

Borrower’s age

Aged 21 years and more, the age should not exceed 65 years of age (inclusive) on the expiry date of the mortgage loan

For example: for a family with one child = applicant (male) 52.5 sq.m. + wife 21 sq.m. + one child 21 sq.m.
Thus, the total permissible area owned by the family is 94.5 sq.m.

Requirements for the real estate

Type of ownership, term of use

Real estate registered in compliance with legislation: an apartment in a residential building, the apartment type (is multi-apartment house), a house (along with the land plot where it is located ), including townhouses

The subjects of mortgage cannot be the following:

  • premises of housing stock intended for temporary residence;
  • for 1st–4th categories of lending at 3% and for the 1st category at 7% – an apartment in a house or a residential building ready for functional use:
    - 10 years before the contract conclusion date, if such real estate object is located in the regions of Chernihiv, Sumy, Kharkiv, Zaporizhia and Kherson;
    - three years before the contract conclusion date, if such real estate object is located in other regions (except the regions of Chernihiv, Sumy, Kharkiv, Zaporizhia and Kherson) or Kyiv city;
  • for the 2nd category of lending at 7% – an apartment in a multi-apartment house or a residential building ready for functional use 10 years before the mortgage contract conclusion date;
  • for the 3rd category of lending at 7% – an apartment in a multi-apartment house or a residential building ready for functional use three years before the mortgage contract conclusion date;
  • garden or country houses;
  • real estate located in the area of military actions (hostilities), in the territory of Autonomous Republic of Crimea or in the territory temporarily occupied, encircled or blockaded;
  • a residential building located on a land plot which does not belong to the lands for residential or public development;
  • a house or an apartment in a residential building which is an architectural monument included in the State Register of Real Estate Monuments of Ukraine.

The regulatory area for real estate

  • for apartments in multi-apartment buildings is 52.5 m² for one family member + 21 m² for each subsequent family member;
  • for houses and townhouses is 62.5 m² for one family member + 21 m² for each subsequent family member.

Who can get a mortgage under the “eOselia” program?

Residents of Ukraine aged 21-65 (at the moment of the full loan repayment), with an officially confirmed income and pertaining to the category of citizens stipulated by the Resolution No. 856 ( Military personnel, health care professionals, scientists and pedagogical employees, war veterans and their family members; combatants, persons with disabilities due to the war, families of deceased (fallen) war veterans, internally displaced persons, other citizens of Ukraine who do not own residential real estate or whose ownership does not exceed 52.5 sq.m. for a family of one person (a single person) and, additionally, 21 sq.m. (for each subsequent family member).

What is the maximum loan amount stipulated by the Resolution No. 856?

The value of 1 sq.m. of total residential area shall not exceed the threshold value for 1 sq.m. of dwelling size. the threshold value for 1 sq.m. of the total residential area is as follows:

  • for the cities of Kyiv, Dnipro, Lviv, Odesa and Kharkiv - shall not exceed the doubled and cost and the indirect cost of dwelling construction by regions of Ukraine as defined by the Ministry of Regions*;
  • for the cities with a population over 300,000 persons, regional centers, settlements located less than 15 kilometers away from Kyiv and for regional centers - the cost is doubled;
  • for cities and other settlements with a population below 300,000 persons, - the cost is increased by 1.75 in the respective region.

Indicators of indirect cost of dwelling construction by regions of Ukraine.

The standard residential area provided for a family of one person (a single person), shall not exceed 52.5 sq.m. of the total residential area and, additionally, 21 sq.m. for each subsequent family member - for apartments; and 62.5 sq.m. of total area and, additionally, 21 sq.m. for each subsequent family member for houses.

The amount exceeding the threshold value for 1 sq.m. of dwelling and that of the standard area shall be covered by the borrower at the expense of the first installment.

Can a mortgage be repaid in an installment that exceeds the fixed monthly installment?

Yes, it can. The funds exceeding the installment will be directed to the repayment of principal.

In what cases a guarantor is required?

A guarantor is required in the cases when the main borrower lacks solvency.

For the “Military personnel” category surety is obligatory.
