Can the bank require a customer to purchase the products which are not included in the banking service package?

The bank is prohibited from requiring customers to purchase any products or services from the bank or a related party/affiliate, as a prerequisite for the provision of these services (except for the provision of the banking service package).

Is the bank entitled to amend the agreement?

The bank is not entitled to unilaterally amend the agreements concluded with customers, unless is otherwise stipulated by the agreement or by law.

Can the agreement on the provision of the banking service be terminated early? How to terminate such an agreement?

Pursuant to art. 651 of the Civil Code of Ukraine, the agreement can be unilaterally terminated, by sending the relevant notice to the Borrower. The agreement shall be deemed as terminated on the date stated in the notice. Nevertheless, on the last day of the Agreement validity, the Borrower shall undertake to return the loan amount in full to the lender and completely fulfill other obligations under the agreement. An unilateral withdrawal from the agreement, shall not release the Borrower from the liability for breaching the contractual obligations.

What are the possible consequences for a customer in the case of an improper use of the banking service or the failure to fulfill obligations under the agreement on the provision of this banking service?

In the case of making untimely payments under the housing loan the customer shall:

  • pay the percentage in the amount of the currently valid double interest rate pursuant to the agreement, within the relevant period, on the overdue amount of the principal for the use of the loan, from the day following the date since the obligation becomes overdue; the customer shall pay to the bank the interest of the amount under the loan not-repaid in time, which, pursuant to Part 2 Art. 625 of the Civil Code of Ukraine shall be established by the agreement of the parties as a percentage of the overdue amount of the loan principal in the size of the doubled interest.
  • the penalty in the amount of the NBU double accounting rate, valid within the period for which the penalty shall be paid, on the amount of the late payment, but not less than 1 hryvnia for each day of delay and not more than 15 percent of the late payment amount. The penalty shall be paid in hryvnia.

Can a customer, upon the termination of the agreement, obtain a certificate confirming that parties have fulfilled their contractual obligations?

Yes. A customer, upon the termination of the agreement on provision of the banking service, , including in connection with the expiration, termination or fulfillment of obligations under the agreement, has the right to request the bank to provide the certificate confirming that the parties have fulfilled their contractual obligations, including with the option to obtain the information (a certificate) on the absence of debt and on the customer’s full execution of the obligations under the agreement, which the bank shall provide in the form of a paper or as an electronic document (at the customer’s choice) within five business days from the day when the bank receives such a request.

The customer may order the electronic document (the certificate) on his/her own in Privat24, by going to the menu - “Services – Certificates - Standard certificates” (the needed certificate should be selected from the list) – “Certificate on Card/Account Closure”/ “Certificate on the Loans”/ “Certificate on the existing/absent debt in the bank”.

The customer may visit the bank branch and obtain the certificate in a paper medium, which will be charged at the bank’s current rates.

Customer category

  1. War veterans and their family members; combatants; persons with disabilities due to the war; families of deceased (fallen) war veterans, as defined by Article 10 of the Law of Ukraine “On the Status of War Veterans, Guarantees of their Social Protection”, and families of deceased (fallen) Defenders of Ukraine.
  2. Internally displaced persons.
  3. Other citizens who do not own residential real estate or whose ownership does not exceed 52.5 sq.m. for a family of one person (a single person) and, additionally, 21 sq.m. for each subsequent family member (excluding the objects of the residential real estate located in the territories of active hostilities and/or in the territories temporarily occupied by the Russian Federation, which are included into the list of territories (approved by the Ministry of Reintegration), where the hostilities either took place or are still ongoing, or the territories are temporarily occupied by the Russian Federation, for which the end-date of the hostilities or temporary occupation is undetermined).

Real estate of the borrower

A customer and his/her family members shall own no more than 52.5 sq.m. of the total residential area for a family of one person (a single person) and, additionally, 21 sq.m. for each subsequent family member (excluding the real estate located in the military (hostility) zone or in the territories temporarily occupied, encircled or blockaded)

Borrower’s age

Aged 21 years and more, the age should not exceed 65 years of age (inclusive) on the expiry date of the mortgage loan

Real estate of the borrower*
For example: for a family with one child = applicant (male) 52.5 sq.m. + wife 21 sq.m. + one child 21 sq.m.
Thus, the total permissible area owned by the family is 94.5 sq.m.
