The bank is prohibited from requiring a customer to purchase any goods or services from the bank or a related or affiliated person as a mandatory condition for the provision of these services (except for the provision of a banking package).

Does the bank have the right to amend the contract?

The bank does not have the right to amend contracts concluded with customers unilaterally, unless otherwise specified in the contract or by law.

Is it possible to terminate a banking service contract early? How to terminate such a contract?

According to Art. 651 of the Civil Code of Ukraine, unilateral termination of the contract is possible by sending the borrower a corresponding notification. On the date specified in the notification, the contract is considered terminated. At the same time, on the last day of the contract, the borrower shall repay the loan amount to the lender in full and fulfill all other obligations under the contract. Unilateral termination of the contract does not exempt the borrower from liability for breach of obligations.

May a customer obtain a certificate upon termination of the contract on the fulfillment by the parties of their obligations established by the contract?

Yes. The customer has the right after the termination of the contract on the provision of banking services, in particular in connection with the expiration, termination or performance of such a contract, to apply to the bank with a request to receive a certificate on the fulfillment by the parties of their obligations established by the contract, including information (certificate) on the absence of debt and the fulfillment of the customer's obligations under the contract in full, which the bank provides in the form of a paper or electronic document (at the customer's choice) within five business days from the date of receipt by the bank of such a request.

The customer can independently order an electronic document (certificate) in Privat24, menu "Services - Certificates - Standard certificates" (you need to select the required certificate from the list) - "Certificate on closing a card/account" / "Certificate on loans" / "Certificate on the presence/absence of debt in the bank".

The customer can contact the bank branch to receive a certificate on paper in accordance with the bank's current rates.

What are the possible consequences for the customer in the event of using a banking service or failing to perfom obligations under the banking service contract?

In the event of default on timely payments under a housing loan:

  • payment of interest at a rate equal to double the contractual interest rate, which is in effect in accordance with the terms of the contract in the relevant period, on the overdue amount of debt on the principal amount of the loan for using the loan, starting from the day following the date of overdue of such obligation; the customer pays the bank interest on the amount of the loan not repayed on time, which, in accordance with Part 2 of Article 625 of the Civil Code of Ukraine, is established by agreement of the parties as a percentage of the overdue amount of debt on the principal amount of the loan in the amount of double interest;
  • penalty in the amount of double the discount rate of the National Bank of Ukraine, which was in effect during the period for which the penalty is paid, on the amount of the overdue payment, but not less than 1 hryvnia for each day of delay and not more than 15 percent of the amount of the overdue payment.
